Nunateeco operates an online platform that allows users to design, customize, and sell their own T-shirts and merchandise.
We maintain a strict policy against the creation or sale of any products that infringe upon the intellectual property rights of others, including but not limited to copyrights, trademarks, and related protections.
If you believe that a user on Nunateeco has violated your intellectual property rights, please follow the reporting procedure outlined below.
A. Reporting Intellectual Property Infringement:
(1) Nunateeco will take appropriate action, including blocking or removing specific content (“Content”), upon receiving a valid notification that indicates a potential infringement of intellectual property rights.
(2) Repeat offenders may have their accounts permanently terminated. If you believe that any content hosted on the Nunateeco platform infringes your intellectual property rights, please send an infringement notice including the following details to our designated agent:
- A description of the copyrighted or protected work, including registration numbers or documentation if available.
- Identification of the infringing material, including:
- (a) A clear explanation of how the content violates your rights.
- (b) The location or URL of the infringing material on the Nunateeco website, with enough detail for us to locate it.
- Your full contact information, including your name, physical address, telephone number, and email address.
- A statement, made under penalty of perjury, confirming that you believe the use of the material is unauthorized by the copyright or intellectual property owner, its agent, or the law.
- A declaration that the information provided in your notice is accurate and that you are the rightful owner or are authorized to act on behalf of the owner.
- Your physical or electronic signature.
B. Actions Taken Upon Receipt of an Infringement Notice:
- Nunateeco will promptly remove or restrict access to the reported content.
- The user responsible for the content will be notified about the action taken and given an opportunity to respond.
- Users who repeatedly violate intellectual property laws or this policy will have their content removed and may face permanent account termination.
C. Filing a Counter-Notice:
If you believe that your content was removed in error or that you hold the necessary rights to use it, you may submit a counter-notice containing the following information:
- A description of the material that was removed and its previous location on Nunateeco before it was taken down.
- A statement, made under penalty of perjury, affirming that you believe the content was removed by mistake or misidentification.
- Your full contact details, including your name, mailing address, phone number, and email address.
- A declaration consenting to the jurisdiction of the Federal Court in your district or, if you are outside the United States, the jurisdiction where Nunateeco is located.
- Your electronic or physical signature.
If a valid counter-notice is received, Nunateeco may forward it to the original complainant. Unless legal action is initiated, the removed content may be restored within 10 to 14 business days.
Please note that under Section 512(f) of the DMCA, any person who knowingly files a false claim of copyright infringement may be held legally responsible for damages, including attorney’s fees and related costs.
